E-Verify

Chapter 633, Title 40.1-11.2 establishes that all agencies of the Commonwealth shall be enrolled in the E-Verify program and use the E-Verify program for each newly hired employee who is to perform work within the Commonwealth.  

To access up to date information regarding E-Verify program enrollment, compliance procedures and case determinations regarding an individual’s authorization to work in the United States, visit the E-Verify webpage at the U.S. Citizenship and Immigration Services. E-Verify Service Agents provide live assistance Monday through Friday from 8:00 am EST to 5:00 pm local time, except on federal holidays. Form I-9 Compliance

Federal immigration reform laws, such as the Immigration Reform and Control Act of 1986 and related amendments, established compliance procedures such as the Form I-9.  Employers must complete the Form I-9 to ensure that all individuals hired to perform work are authorized for employment in the U.S.  All State agencies must verify the identity and employment authorization of each new hire and rehire within three business days of the employee’s start date.  This includes completing and retaining a Form I-9 for each employee, reviewing and recording the documentation presented, and refraining from discriminating against employees and potential employees on the basis of national origin or citizenship.
