Complaint of Discrimination

File a Complaint

If you believe that you have been discriminated against or subjected to harassment or retaliation, and you are a state of Virginia government employee or applicant for employment, you may file a discrimination complaint with DEI. To file a complaint:

  • Submit the Discrimination Complaint Form. Forms may be obtained by contacting our office.
  • Describe or identify the person(s) or agency(ies) involved.
  • Describe the allegations of discrimination in detail, including any supporting documentation and names of witnesses to the incident(s) of discrimination.
  • Sign and submit the completed form to DEI within 180 calendar days of the last alleged discriminatory incident(s) or employment action that you feel was discriminatory.

If your discrimination complaint is accepted, it will be assigned to a specialist and the agency will be notified. Upon completion of the EEO investigation, a Letter of Determination will be issued. If discrimination is found, DEI will seek the appropriate remedy.

Consultation and Advice

Individuals seeking confidential advice on discrimination issues may call the DEI at (800) 533-1414 or (804) 225-2136 to speak with a State EEO Specialist between 8:15am and 5:00pm weekdays. Messages may be left after regular work hours. The Specialist will:
  • Listen to your concerns.
  • Explain the relevant employment laws and state policies.
  • Advise you on your options for resolving your concerns.
  • Refer you to other state and federal agencies for assistance, if necessary.
  • Explain how to file a complaint with DEI.

Our office does not:

  • Provide legal advice or representation in EEO matters
  • Render determinations on the matter unless the case is accepted for investigation.
  • Require the caller to provide their name and/or the agency in which they work.
